The Company facilitates hoarding cleanup, estate cleanout, biohazard remediation, odor treatment, debris removal, and related residential and commercial property services within the Ashland, KY service area and surrounding Boyd County region. Specific service scope is confirmed in a written estimate provided prior to commencement. Anything not listed in that estimate falls outside the contracted scope.
All services are rendered on an as-is, where-is basis. The Company makes no guarantee regarding the final condition of any structure, surface, or system following service completion beyond what is expressly stated in a signed work order.
This section governs what the Company is and is not responsible for. It is not boilerplate. It directly affects your rights.
Pre-Existing Structural Damage:The Company and all affiliated service providers assume zero liability for pre-existing structural damage discovered during or after cleanup operations, regardless of when that damage becomes visible. Discovery of such conditions during service does not create any obligation on the part of the Company to repair, remediate, or compensate.
Undisclosed Biohazards and Chemical Contamination:Client is required to disclose all known biohazards, chemical agents, controlled substances, mold colonies, animal waste, sharps, or biological contamination prior to service commencement. The Company assumes zero liability for any undisclosed biohazard not identified before work begins.
Authorized Item Disposal:When Client authorizes โ verbally, in writing, or through a signed work order โ the disposal, removal, donation, or destruction of any items, the Company assumes zero liability for the loss of those items. Once removed and disposed of, items cannot be recovered.
The Company operates in formal adherence to regulations established by the Kentucky Energy and Environment Cabinet (EEC), including applicable standards governing the handling, transport, and disposal of biohazardous waste, regulated solid waste, and chemical contaminants. All field personnel follow EEC-compliant protocols for protective equipment, waste segregation, and disposal site use.
Client must provide unobstructed access to the service premises at the agreed time. Any delay caused by Client may result in a trip fee billed at the Company's standard rate. Client is responsible for securing or removing any pets from the work area. The Company is not liable for injury to animals present during service operations.
Client must identify and physically separate any items designated for retention before the crew arrives. Verbal instructions given to crew members during active work are not a substitute for a pre-service walkthrough.
When a Client acts on behalf of another property owner, estate, or tenant, they represent and warrant that they hold legal authority to authorize cleanup and disposal on that property. The Company will not adjudicate ownership disputes. Any legal claim arising from unauthorized property access or disposal by a Client acting without proper authority is the sole liability of that Client.
Written estimates are based on conditions visible and disclosed at the time of assessment. Discovery of additional material volume, hidden rooms, undisclosed contamination, or structural access issues may result in revised pricing. Client will be notified before additional charges are incurred where conditions allow. Payment is due in full upon service completion unless a written payment arrangement has been confirmed in advance.
Any promotional vouchers, discount codes, or gift cards issued through or in connection with hoardingcleanupashland.com are completely non-refundable under any circumstance. They carry a cash value of $0.00. All promotional vouchers and gift cards are completely void within the State of California and may not be redeemed, transferred, or applied to any service from within that jurisdiction.
To the fullest extent permitted under Kentucky law, the Company's total aggregate liability to any Client for any claim arising from services rendered through this portal shall not exceed the total amount paid by that Client for the specific service giving rise to the claim. The Company is not liable for indirect, incidental, consequential, or punitive damages under any theory of recovery.
Any dispute arising under these Terms shall first be submitted to good-faith negotiation via the Company's dispatch line. If negotiation does not resolve the matter within thirty (30) days, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, seated in Boyd County, Kentucky. Client waives the right to participate in any class action proceeding against the Company.
These Terms are governed by the laws of the Commonwealth of Kentucky without regard to conflict-of-law provisions.
The Company makes no express or implied warranties regarding services provided through this portal. Results vary based on property condition, disclosed information, and Client cooperation. No field personnel statement constitutes a warranty unless confirmed in a signed written addendum.
